Introduction
Timu Corp. (the "Company,"
"we," or "us") takes your right to privacy seriously,
and we want you to feel comfortable using Timu.com (the "Site"). This Privacy Policy
deals with personally-identifiable information (referred to as "data"
below) that may be collected by or through the Site or the Company.
This policy does not apply to other entities that are not owned or controlled
by the Company, nor does it apply to people that are not employees or
agents of the Company or that are not under the Company's control. In
addition to this Privacy Policy, please take time to read the Site's Terms of Service.
1 Collection of
Data
Our primary goal in collecting data from
you is to provide you with complete access to the Site. Registration
for an account on the Site requires limited information, including a
valid e-mail address, a unique user name and a date of birth. Please
be aware that the user name you choose, the e-mail address you provide
and any other information you enter may render you personally identifiable
and may possibly be displayed on the Site intentionally (depending on
choices you make during the registration process, or depending on the
way in which the Site is configured) or unintentionally (subsequent
to a successful act of intrusion by a third party).
The Company may use cookies, clear GIFs
and log file information to (a) store information so that you will not
have to continuously re-enter it on the Site; (b) provide personalized
content and information; (c) monitor our marketing campaigns; (d) monitor
statistics relating to the Site; (e) track your submissions and status
in promotions; and (f) police the Site and enforce the Terms of Use
and any other guidelines for usage. In addition, the Company may use
clear GIFs or web beacons in HTML-based emails sent to you to track
the emails that are opened by recipients.
The Site helps you connect and share
information about yourself with others. You choose what information
you put in your profile. Our systems will permit you to have significant,
but not total, control over what users may see your information; to
take advantage of these features of the system, you will have to become
familiar with and be able to use the settings in your user profile.
You should assume that any personal information or other content that
you voluntarily post to the Site will become publicly available and
can be accessed and viewed by others. Even if you effectively restrict
what information about you may be seen by other users, we can give you
no assurance about what any given user might do with that information.

2 Use of
Data
Data may be used to customize and improve
your user experience on the Site. In addition, data may be used in connection
with administrative communications, marketing communications, promotions
and internal business purposes.
Efforts will be made to prevent your
data from being made available to third parties unless (i) it is information
that you post to the Site or otherwise choose to include or indicate
in your public profile; (ii) provided for otherwise in this Privacy
Policy; (iii) your consent is obtained, such as when you choose to opt-in
or opt-out for the sharing of data; (iv) a service provided on the Site
requires interaction with a third party or is provided by a third party,
such as an application service provider; (v) pursuant to legal action
or law enforcement; (vi) it is found that your use of the Site violates
the Company's Privacy Policy, Terms of Use or other usage guidelines
or if it is deemed reasonably necessary by the Company to protect the
Company's legal rights and/or property; or (vii) the Site is purchased
by a third party, in which case that third party will be able to use
the data in the same manner as set forth in this Privacy Policy.
In addition, we may develop, use, distribute,
and publish information and statistics derived from your data and the
content that you contribute to the Site for use on a masked, aggregate
basis. This particular use of your data and content will not result
in the distribution or publication of your personally identifiable information.
In the event you choose to use any link
displayed on the Site to visit another website, you are advised to read
the privacy policy published on that website.
3 Minors
The Company will not permit persons who
are aged 13 or younger to use or become members of the Site, and we
request that such persons do not provide any personally identifiable
information through the Site. If a parent or legal guardian becomes
aware that his or her child has provided us with personally identifiable
information without the consent of such parent or legal guardian, he
or she should contact us at legal@timu.com.
4 Editing or
Deleting Your Account Information
You are provided with the ability to
edit the information stored for your user account during registration
by visiting your user account web page. You can request that your user
account be deleted; to do so, please contact us at legal@timu.com. Content or other data that you may have provided,
and that is not stored within your user account, such as pictures or
videos, may continue to remain on the Site at the Company's discretion,
even after your user account is deleted. Please see the Site's Terms of Service for more information.
5 Changes to this
Privacy Policy
Changes may be made to this Privacy Policy
from time to time. You will be notified of substantial changes to this
policy either by a posting of an announcement on the Site or by a message
sent to the email address you have provided to us and is stored within
your user settings.
6 Compliance with Laws and Law Enforcement
We cooperate with government and law
enforcement officials or private parties to enforce and comply with
the law. We may disclose any information about you to government or
law enforcement officials or private parties as we, in our sole discretion,
believe necessary or appropriate to respond to claims and legal process,
to protect our rights and the rights of third parties, to protect the
safety of the public or any person, to prevent or stop illegal, unethical
or legally actionable activity or to otherwise comply with the law.
7 NO GUARANTEES
While this Privacy Policy states standards
for maintenance of data, and while efforts will be made to meet these
standards, the Company does not guarantee that it will comply with these
standards. There may be factors beyond the Company's control that may
result in disclosure of data. Consequently, the Company offers no warranties
or representations regarding the maintenance or non-disclosure of data.
